    Information Guidelines

    These Information Guidelines outline some of the statutory and procedural considerations of the Integrity Commissioner when deciding how ACLEI obtains, handles, uses or disseminates information in the exercise of the Integrity Commissioner's functions under the Law Enforcement Integrity Commissioner Act 2006.

    These guidelines also alert people to the issues that the Integrity Commissioner may consider when assessing any application for release of information that ACLEI may possess. If you are considering seeking information from the Integrity Commissioner, please read these guidelines before approaching ACLEI for the release of any information.

    Hearings and Notices to Produce – Guidance for people responding to coercive powers

    ‘Notice to produce’ – Guidelines

    These Guidelines are intended to inform a person who receives a written request (commonly called a ‘notice to produce’) under section 75 or 76 of the Law Enforcement Integrity Commissioner Act 2006 (the LEIC Act), and a legal practitioner who represents such a person, of the person’s rights and obligations and of the manner in which applications relating to those rights and obligations should be made to the Integrity Commissioner.

    Hearings - Practice Notes

    Practice Notes are intended to inform and guide the conduct of appearances and legal representation before or in connection with hearings before the Integrity Commissioner. The Practice Notes are designed to promote the efficient and effective conduct of hearings. Legal practitioners must ensure that relevant requirements are observed.

    Witness Expenses

    Witnesses called before an ACLEI hearing may be eligible to receive reimbursement for some expenses reasonably incurred in attending the hearing. Reimbursement of expenses may be claimed by submitting a completed Witness Expense Form to the Australian Commission for Law Enforcement Integrity, GPO Box 305, Canberra City, ACT, 2601 Attention: Senior Legal Officer.

    Legal and Financial Assistance

    Witnesses called before an ACLEI hearing are eligible to make application under the provisions of section 103 of the Law Enforcement Integrity Commissioner Act 2006 (LEIC Act) to the Attorney- General, in respect of legal assistance and/or financial assistance (other than witness expenses) concerning their appearance before the Integrity Commissioner.

    Any application for legal and/or financial assistance must be made to the Attorney-General's Department (AGD) and not to the Integrity Commissioner nor the Australian Commission for Law Enforcement Integrity (ACLEI).

    The Application for assistance with legal and related expenses form should incorporate as much information as possible to assist AGD is assessing any claim. All inquiries relating to this scheme should be made to (02) 6218 7070.

    The assistance provided under the provisions of section 103 of the LEIC Act, does not relate to costs for travel, accommodation or meals incurred by a witness relating to their appearance before the Integrity Commissioner. Reimbursement of those costs is regulated by section 83(6) of the LEIC Act and schedule 1 of the Law Enforcement Integrity Commissioner Regulations 2006.

    Any claim for travel, accommodation or meals, should be submitted by using the 'Witness Expense Form' which is provided above.
